I have been in the Real Estate business for over 20 years. In that time I have helped many buyers, sellers and investors achieve their goals with real estate. In addition to being a traditional agent, I have worked for two real estate investment companies within their acquisition departments. I was Acquisition Manager and helped them purchase over 400 homes. It doesn't stop at residential properties, I have experience with commercial properties and multi-family as well!

Foreclosure In Arizona

Information

In Arizona, most foreclosures are handled through a non-judicial foreclosure process, which is generally faster than court-based foreclosure. Here’s the breakdown:

1. Missed Payments

The process usually starts after a borrower misses payments on their mortgage. Most lenders will contact the borrower first to try to resolve it.

2. Notice of Default / Breach

Arizona deeds of trust usually require notice before acceleration (calling the full balance due). This gives the homeowner a short period to catch up.

3. Notice of Trustee Sale

Because Arizona commonly uses a Deed of Trust (not a mortgage), the lender can appoint a trustee to foreclose without filing a lawsuit.

The trustee records a Notice of Trustee Sale with the county recorder. This notice must:

Be recorded at least 90 days before the sale.
Be mailed to the borrower and other lienholders.
Be posted on the property and published.

This is the main public signal investors watch.

4. Reinstatement Rights

Up until 5:00 p.m. on the business day before the sale, the borrower can usually reinstate by paying:

Past-due payments
Late fees
Trustee fees
Legal costs

This is important because many “pre-foreclosures” never make it to sale.

5. Trustee Sale (Auction)

The property is sold at public auction to the highest bidder, usually for cash or certified funds.

Possible outcomes:

Third-party investor buys it
Lender takes it back (becomes REO)

6. After the Sale

Arizona is important because:

No redemption period after a trustee sale (in most cases). Once sold, ownership transfers fast.
Eviction can begin if occupied.

Deficiency Judgments in Arizona

Arizona has some strong anti-deficiency protections:

For certain residential properties (2.5 acres or less, single or two-family), lenders often cannot pursue the borrower for the unpaid balance after foreclosure.

This matters for negotiations and short sales.
